What is a power of attorney?

A power of attorney is a legal document that authorizes a specific person to oversee your personal matters such as your healthcare and/or finances. With a durable power of attorney, in the event that you were to become debilitated from an illness or unforeseen accident, that document would remain in force. This legal document must be signed and notarized. A proper power of attorney can act as a safeguard if you are met with a medical emergency or a mental heath crisis.

A power of attorney includes general language that gives authorization to the person designated to handle all of your financial, medical, and legal matters. A limited power of attorney is different in that it gives specific authorizations to a certain person. For example, authorizing a close family member to make all medical related decisions if you were to become incapacitated.

 

A power attorney is only valid as long as you are mentally competent where as a durable power of attorney includes specific language that allows it to remain effective if your mental or physical health was to decline.

There are many free templates online for a power of attorney form but it is always good to speak to an attorney about your options.
